Introduction

As the use of generative AI tools becomes more widespread, for both lawyers and litigants in person, it is important to be aware of the limitations of such technology and the need to carefully check the outputs provided.

There is an increasing body of cases in the UK involving parties citing cases that don’t exist or putting forward quotes or propositions that have not originated from the cases they are attributed to.

This issue has most recently been dealt with in the context of trade mark proceedings in the Appointed Person decision of ProHealth.

This short webinar will review the current state of affairs, and focus on some of the issues specific to the Trade Mark Registry as a Tribunal (rather than a court).

It will also touch on the duties of both litigants in person and professional representatives (including solicitors, barristers and trade mark attorneys).

As the use of GenAI is only going to increase over time, it is important for those appearing before either the UKIPO or the Appointed Person to be away of their duties and obligations, as well as the potential sanctions they may face if they do rely on hallucinated content in a case.

The webinar is suitable for UK trade mark practitioners and those with clients or business operations in the UK.
