Introduction
The process of dismissing employees and offering them re-engagement on new terms as a way of managing a variation of contract has attracted a lot of controversy. It is seen by some as an imbalance of power, and by others as a necessary tool for management.
In response to the controversy the Conservative government issued a Code of Practice (which came into force in July 2024), setting out some safeguards in the ‘fire and rehire’ process.
The Labour government has gone further and will add new restrictions to the use of Fire and Rehire as a result of the Employment Rights Bill. These changes will take effect in October 2026.
