Introduction

This webinar will explore the court’s treatment of conduct in financial remedy proceedings, focusing on both litigation misconduct and conduct under section 25(g) of the Matrimonial Causes Act 1973. It will outline how these two forms of conduct differ and discuss the possible implications and outcomes that may result from each.

You will be guided through the relevant provisions of the Family Procedure Rules (FPR), alongside procedural directions and practical advice on how to raise and address conduct issues effectively in practice.

A key focus will be the case of OG v AG, in which Mostyn J identified four distinct categories of conduct. The presenter will examine each of these in depth, drawing on her own professional experience and relevant case examples. The webinar will also consider the cases of Crowther v Crowther and Tsvetkov v Khayrova, where Mostyn J’s reasoning was subsequently applied.
