With the proliferation of electronic devices and social media, digital evidence and disclosure have never been more relevant. Whilst this applies to all criminal offences, sexual offences provide a particular challenge. The ‘digital strip search’ provides challenges to prosecutors, defence lawyers and investigators alike. In response, the Court of Appeal, Parliament and the Attorney General have issued updated guidance, codes of practice and guidelines.

With disclosure (or the lack of) being one of the major causes of adjournments, now is the time to be across the issues, law and guidance with regards to the handling of digital data in criminal trials.
