Introduction

This short webinar addresses some key points that practitioners should know when dealing with problems with wills before a grant of probate has been obtained.

The situations to be considered include where a will has been damaged, written on, or has gone missing - including what to do when not even a copy of the will is available - as well as how to deal with a person who appears to have a will but refuses to provide it or seek probate of it and, conversely, the question of whether a person who might be opposed to a will should be provided with it before probate is obtained.

What You Will Learn

The webinar will cover the following:

  • The rules applying to damaged or altered wills
  • Guidance on the approach to disclosure of a will before a grant has been made
  • The use of applications under sections 122 and 123 of the Senior Courts Act 1981
  • The uses and limitations of caveats and citations under the Non-Contentious Probate Rules 1987
  • The procedure for obtaining probate of a missing will

This pre-recorded webinar will be available to view from Friday 27th February 2026

Alternatively, you can gain access to this webinar and 1,900+ others via the MBL Webinar Subscription. Please email webinarsubscription@mblseminars.com for more details.
