Introduction

This new virtual classroom seminar will equip practitioners with the practical knowledge to identify cases where rectification or construction is an issue, an understanding of the legal framework, and the procedural know-how to run such cases effectively.

It is suitable for litigation solicitors practising in England and Wales, with experience in private client work, particularly those specialising in contentious probate and trust litigation who seek to deepen their expertise in resolving disputes arising from defective or ambiguous testamentary documents.

What You Will Learn

This live and interactive course will cover the following:

  • The statutory framework under sections 20 and 21 of the Administration of Justice Act 1982
  • The interplay between rectification and construction claims
  • Evidential strategies for proving clerical error or misunderstanding
  • Practical guidance on how to run their claims
  • An overview of recent case law

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
