Introduction

This webinar is about the competition law issues you face when engaged in a supply chain, whichever end of it you are in.

The issues arising could for example be, can you collaborate with another supply chain member, can you bid for a contract together with the prime, and what restrictions can one party place on another to prevent it competing with it? There is also a growing interest in sharing information that is sensitive, particularly where one party takes over another or they engage in a joint venture.

This webinar will interest all lawyers working in supply chain management teams, whether in industry, public sector or external advisors (legal or other consultancies) who work closely with the set-up, development and management of contract activity within a supply chain.

What You Will Learn

This webinar will cover the following:

  • Definitions of supply chain and prime
  • Subsidy Control - in-shoring of supply chain through prime
  • NSIA - off-shoring of supply chain by prime
  • Chapter I Competition Act 1998 - vertical restriction arrangements and dual distribution between prime and supply chain
  • Chapter I Competition Act 1998 - horizontal restrictive arrangements and upstream restrictions
  • Chapter I Competition Act 1998 - Block Exemptions (R&DBEO and SABEO)
  • Chapter I Competition Act 1998 - extended enterprises and bid rigging (including exchange of competition sensitive information)
  • Chapter II Competition Act 1998 - abuse of dominant position (prime to supplier and supplier to prime) monopoly and monopsony
  • Merger Control - vertical consolidations and killer acquisitions
  • Procurement Law - when public sector is prime (NHS)
