Introduction

This webinar is for those practitioners (prosecution, defence, legal advisers) who deal with matters in the Youth Court. It is not an easy court and one constantly has to have in mind changes brought about by legislation and High Court decisions as to how matters should be dealt with there.

This webinar will increase your knowledge and thereby increase your confidence as an advocate or adviser when appearing in the Youth Court.

What You Will Learn

This webinar will cover the following:

  • Serious offences - should jurisdiction be retained whereby the trial is in the Youth Court or should the case be sent to the Crown Court for trial? - latest from the High Court
  • Changes brought about by the Judicial Review and Courts Act 2022 whereby Crown Court Judges have wider powers to both send youths back for trial or commit for sentence
  • Changes brought about by the Police, Crime, Sentencing and Courts Act 2022
  • A straightforward remand into the care of the Local Authority or an application that the youth be kept in Youth Detention Accommodation (YDA) - the legislation explained
  • A committal from the Youth Court to the Crown Court for sentence under the Sentencing Act 2020 - the law is very different from that which applies in the Adult Magistrates’ Court
  • The sentence is one of detention by way of a Detention and Training Order - is release possible at the 40% stage rather than the 50% stage?
  • The sentence is one of detention by way of a Detention and Training Order - is the youth eligible for early release under the Home Detention Curfew Scheme?
  • The position on murder in the Youth Court
  • Cases where the Youth Court simply does not have jurisdiction and the matter must therefore be sent to the Crown Court
  • The role of the Referral Order
  • Orders that may be made in the Youth Court against parents or guardians
  • The position on financial orders in the Youth Court - who should be made responsible for payment?
