Introduction

Mental health in the workplace, with particular focus on issues involving stress at work, is an increasingly important and prevalent topic.

As such, employees are more aware of their legal rights to raise complaints with their employer and, in turn, there is increased emphasis on employers managing complaints of stress at work with a greater degree of scrutiny. The expectation therefore is that claims for personal injury caused by exposure to stress at work is likely to increase and therefore it is important that personal injury practitioners supporting Claimants in this area of law are well equipped to advise and case manage cases competently.

This webinar aims to build up the knowledge and expertise of Claimant personal injury fee earners who already work in this field by looking at a detailed review of foreseeability, consideration of other personal injury considerations in addition to the usual psychiatric illness claim and an overview of important estoppel considerations in respect of the overlap with employment law.

What You Will Learn

This webinar will cover the following:

  • A brief overview of the legal hurdles to overcome for a successful stress at work claim
  • An analysis of foreseeability - the law on foreseeability, recent case law, practical considerations and what to look out for
  • Identifying psychiatric illness - when might stress symptoms be deemed a psychiatric injury, what other personal injury claims may be relevant with a review of developments in clinical research into associated physical injuries and what to look out for in medical records
