Separation & Divorce in Modest Asset Cases - A Guide for Family Lawyers
Introduction
In his second ‘View from the President’s Chambers’ dated 7 May 2019 the new President of the Family Division Andrew Macfarlane noted that:
‘The development of the FRC should bring additional benefits, for example, by adapting the data that is captured on the D81 Form, providing a ready resource that records the basic features and outcome of every Financial Remedy case so that, within a short time, it should be possible to publish tables identifying in broad terms the ‘norm’ for particular categories of case or commonly encountered circumstances.’
This recognises that for too long our case reports have been overly weighted towards the extraordinary and high wealth cases.
This live broadcast session will discuss the issues which regularly arise in cases of more limited assets on separation or divorce and look at how we can use these to address the issues at hand.
What You Will Learn
This live and interactive session will cover the following:
- The issues which regularly occur in modest asset cases, such as debt, small housing budgets and division of limited capital assets
- A discussion of some of the less well known solutions used to meet those challenges
- Case law on reported modest asset cases
- How all case law can be applied to the issues of lower asset division
Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
