Introduction

SDLT on residential purchases has changed massively since rates started to increase and multiple dwellings relief was introduced, both in 2011.

Conveyancers are not tax experts. SDLT negligence claims are growing, and can run to tens or hundreds of thousands of pounds. Most claims relate to the 15% rate, or a failure to claim multiple dwellings relief, or not realising that it is not what a property is to be that determines the correct rate of SDLT but what it is on, or has been up to, the effective date. Most recently HMRC has tightened up the mixed-use rules.

In 2016 a 3% surcharge on additional dwellings and on those bought by companies was introduced. Despite changes in the 2017 and 2018 Budgets, the rules can still work harshly and unfairly. First-time buyer relief, introduced in 2017, is not always what clients think it is.

This advanced course assumes that you understand basic SDLT principles, including contract and conveyance, identifying land transactions, subsales, linked transactions, exchanges, chargeable consideration, exempt transactions and land transaction returns.

What You Will Learn

This course will cover the following:

  • Definitions
    • ‘Residential property’ and ‘Dwelling’ are defined, drawing on the latest guidance on ‘dwellings’ and ‘grounds’
  • Chargeable Consideration and Reliefs
    • Assumption of debt as consideration - problems associated with transfers of equity
    • The interplay between site purchase and construction contracts
    • Multiple dwellings relief - more complicated than HMRC guidance suggests
    • First-time buyer relief - ought to be called ‘first-time owner relief’
    • Other reliefs, including those on part-exchanges and collective enfranchisement
  • Higher Rate (15%) and Higher Rates (the 3% surcharge)
    • Companies buying dwellings - if residential, then either 15% or 3% surcharge
    • The complex and anomalous surcharge rules - including the four major exemptions
    • Multiple dwellings and surcharge - even more anomalies
