Introduction

This webinar looks at the value of IP in insolvency and some of the legal issues and possible pitfalls to consider when acquiring brands.

Intellectual property is often overlooked in insolvency processes and those involved may not realise the full value of the assets they are selling or purchasing. To advise clients, it is crucial to identify intellectual property rights, both registered and unregistered, check ownership and carry out an assessment of value.

It can also be attractive to revive an older brand that has seemingly been abandoned, which saves on time and marketing efforts by building off a past reputation.

However, some rights can still exist, or the original brand owner may still retain an interest in the brand, which can prevent a new owner from making use of the so-called ‘zombie’ trade mark.

The webinar is suitable for insolvency practitioners and intellectual property practitioners looking to advise a client on an acquisition or resuming of an older brand.

What You Will Learn

This webinar will cover the following:

  • The role of IP in insolvency situations
  • What happens to IP that belonged to a dissolved company and the process of buying this back from the Crown
  • The risks in acquiring ‘zombie’ marks and relaunching old brands, including goodwill issues

This webinar was recorded on 13th September 2023
