Introduction

This seminar will take attendees through the law and practice relating to applications for disclosure and deposition against companies and individuals in England and Wales in aid of proceedings overseas. Such applications are generally made or assisted by English firms and are made under the Evidence (Proceedings in Other Jurisdictions) Act 1975.

This interactive workshop session will cover when applications of this sort are appropriate and what must be shown if the application is to succeed. It will also look in practical terms at how the applications are made and what common pitfalls should be avoided. It will also cover what happens next after an order is made.

What You Will Learn

This seminar will cover the following:

  • The relevant principles contained in the Evidence (Proceedings in Other Jurisdictions) Act 1975
  • The procedure for making an application
  • The applicable rules on the costs of an application
  • What to do before making an application
  • How to defeat an application made against your client
  • What happens next if an order is made
