Unannounced inspections or ‘dawn raids’ are used by antitrust authorities to obtain evidence when there are suspicions that individuals or businesses have infringed the antitrust rules. The surprise element of dawn raids offers reassurances to investigators that evidence of a possible infringement will not be destroyed. The conduct of the employees of the company under investigation during a dawn raid can have material consequences on the company’s liability exposure and right of defence.

Many businesses will have protocols for responding to a dawn raid. The issue that these protocols ought to cover - but often don’t - is how to deal with the arrival of digital forensic investigators and dawn raids in domestic premises, as dawn raids are increasingly being carried out through the interrogation of electronic (as opposed to paper) files and often extend to the domestic premises of key individuals.
