Introduction

During the course of negotiations for financial remedy orders and contested proceedings, the conduct of the parties will often be raised. Section 25(2)(g) of the Matrimonial Causes Act 1973 allows conduct to be considered when it will be ‘inequitable to disregard it’.

The issue of ‘add back’ is where a court adds back into the matrimonial pot any funds which is finds that one party has used or spent that reduced the matrimonial pot.
