Introduction

Pricing transparency is increasingly a high priority for the Competition and Markets Authority (‘CMA’), with further enforcement set to continue in 2024/2025.

The risks in this area will only increase now that the CMA has been granted new powers to impose penalties of up to 10% of global turnover under the Digital Markets, Competition and Consumers (‘DMCC’) Act.

Consumer law is having to evolve quickly to respond to emerging issues such as dynamic and personalised pricing (including via the integration of AI) - while tackling misleading price promotions and bogus discounts remain high on the CMA’s agenda.

What You Will Learn

This webinar will cover the following:

  • An overview of the legal framework governing misleading pricing and promotions, including changes introduced by the DMCC Act

  • CTSI guidance for traders on pricing practices and overview of relevant Trading Standards prosecutions, including the H Samuel and Tesco cases
  • An update on the rules in relation to drip pricing under the DMCC Act and previous CMA enforcement, including the online car intermediaries case
