With leasehold conveyancing becoming a growing area due to the increasing percentage of homebuyers choosing to purchase flats or apartments, the purpose of this introductory level course is to focus on practical issues that may arise at key stages of a conveyancing transaction.

What You Will Learn

This full day course will concentrate on a number of issues, including the following:

  • The Lease
    • Addressing common defects in long leases
    • Reporting to the client on the lease
    • What steps can be taken if the lease or part of the lease is missing?
    • Are the service charge provisions adequate?
    • Does the lease clearly allocate responsibility for repair?
    • Are there any provisions in a superior title that need to be checked?
    • Shared ownership leases and their peculiarities
    • Retirement flats and exit fees
    • Is a deed of variation required?
  • Documentation for which Fees are often demanded
    • Alterations to flat
    • Replies to pre-contract enquiries
    • Licence to assign or sublet
    • Deeds of covenant
    • Post-completion notices
  • The Contract
    • Matters to consider on the grant or assignment of a lease, e.g. do we need to agree a retention?
    • Important issues to consider on purchase of new apartment
  • The Enquiries
    • Key issues to be addressed when perusing replies to enquiries
    • What if the landlord is absent or unresponsive?
  • Land Registration
    • Dealing with restrictions on the register
    • Good leasehold titles: can we upgrade to absolute?
  • Lenders' Handbook
    • The provisions that specifically deal with leasehold properties
    • Advising the client on any leasehold documents not required by lender
  • Reporting to client on investigation into the leasehold title
