Introduction

One of the unique aspects of some tenancies granted under the Agricultural Holdings Act is the ability to pass on the tenancy to future generations.

This virtual classroom seminar will look at this process in detail, who is eligible and suitable to succeed and will answer all of your questions about how to plan for this successfully with agricultural landlords and tenants.

  • The provisions in the 1986 Act that govern succession - eligibility and suitability criteria, time limits
  • Amendments to this brought in by the Agriculture Act 2020
  • Agricultural Holdings (Requests for Landlord’s Consent or Variation of Terms and the Suitability Test) (England) Regulations 2021
  • Guidance on dealing with applications in the First Tier Tribunal (England) and the Agricultural Land Tribunal (Wales) and the different legislative positions further to the above
  • Completion of the forms, and evidence required
  • Process through to final hearing of succession applications
  • Negotiation and without prejudice conversations
  • Planning ahead for succession - what to put in place and when
  • Case law providing specific examples will be referred to throughout
