Introduction

This new virtual classroom seminar addresses the aspects of how the compensation recovery unit (CRU) and NHS charges interact with personal injury litigation.

These two issues affect claims from the outset of the action, through to after the conclusion of a settlement or judgment. They can affect how much compensation can be deducted from a settlement and whether an offer can be invalidated for failure to comply with CPR, Part 36.

What You Will Learn

This live and interactive session will cover the following:

  • How CRU and NHS charges interact with personal injury claims in England and Wales
  • The legislation and relevant case law
  • How benefits are calculated and applied to personal injury claims, from the outset of the claim through to and including an appeal of the benefits certificates
  • How benefits can be offset, which benefits are capable of being offset against which heads of loss and how different types of offers are affected by CRU benefits
  • How offers are quantified in light of applicable CRU benefits and deductions, and the potential errors that can arise if benefits that are noted on CRU Certificates not correctly applied to settlement offers
  • How applicable benefits can be challenged through the CRU’s appeals process
  • How NHS charges are quantified, how they can affect the settlement of claims, and how they can be challenged in the CRU’s appeals process
  • The relevant future issues surrounding Universal Credit and the impact of its recent expansion during the pandemic, and how this will affect personal injury claims in the future
