Introduction

This virtual classroom seminar will provide an update on legal developments in the field of historical child abuse claims in Scotland.

Following upon the introduction of The Limitation (Childhood Abuse) (Scotland) Act 2017 which removed the three year statutory limitation for commencement of actions in Scotland relating to child abuse, there have been various developments in the law. This live session will provide a detailed exploration of those developments.

What You Will Learn

This live and interactive session will cover the following:

  • An update about the impact of the Limitation (Childhood Abuse) (Scotland) Act 2017
  • The practical application of the available defences of ‘substantial prejudice’ and ‘fair hearing’
  • A case law update with particular focus on A x XY Ltd and B&C v Sailors’ Society

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
