Introduction

The Unified Patent Court (‘UPC’) opened its doors for business on 1 June 2023, a date which also marked the start of the Unitary Patent. But the UK jurisdiction is not participating in either.

Where does this leave English patent litigation, given the comparative size of the market covered by the UPC?
