Introduction

Paperless offices and virtual conveyancing are firmly with us and like it or not conveyancers have to deal with a new age.

Accelerated by the pandemic increasingly our work is online, so it is timely to take a closer look at the portal and business e-services.

Whilst Land Registry applications are through the portal in a majority of cases this has not yet reached a hundred percent, but it is expected in due course to do so. It is timely to examine some of the basics involved and some of the difficulties you might experience.

What You Will Learn

This webinar will cover the following:

  • What is the portal and what is it for?
  • Conditions for using the portal - Conditions of use: Portal and Business Gateway (COU), Network Access Agreement (NAA)
  • What is meant by ‘The Responsible Person’, ‘Deputy Responsible Person’, ‘Administrator’ and ‘Authorised User’?
  • The sharing and deletion of accounts, Land Registry reports and other additional services
  • Examples of applications via the portal and making an application enquiry
  • Portal users and the View My Applications service
  • The Registry’s Digital Registration Service
  • Lender services - Lenders using the portal to discharge mortgages and the Memorandum of Understanding (MOU)
  • Electronic signatures, computers and paperless conveyancing, digital ID and Land Registry ‘Safe Harbour Standard’
  • Problems of reliance on computer-based practice and should your clients have the same access to the portal as the conveyancer?
  • Law Commission and smart contracts
  • Virtual or physical - you have to read the title - a salutary tale R (on the application of HCP (Hendon) Ltd) v Chief Land Registrar (sued as HM Land Registry) [2020]
