Introduction

Running a charity often creates considerable health & safety risks, ranging from hazardous fund-raising activities and operating charity shops, through to the activities that deliver upon the charity’s objectives. This exposes the organisation, its executives and the trustees to potential health and safety criminal prosecution, with the prospect of fines and even imprisonment for the worst cases.

Whilst insurance can cover the charity’s liability to pay personal injury compensation, as a matter of public policy insurers are not allowed to pay criminal fines… and of course insurance also fails to mitigate the impact of criminal prosecution upon the charity’s good reputation, which is a prerequisite for raising funds.
