Introduction

The Domestic Abuse (Protection) (Scotland) Act 2021 came into force on 5 May 2021. The Act introduces additional protective measures for victims of domestic abuse and also additional police powers.

Family lawyers and criminal lawyers need to be familiar with this legislation in order to best represent their clients either as the alleged abuser or as the victim of domestic abuse. By viewing this webinar you will be able to advise clients fully on the new procedures available to the Chief Constable and on the options available to Sheriffs for disposal of these cases.

What You Will Learn

This webinar will cover the following:

  • What are Domestic Abuse Protection Notices and Orders?
  • What is ‘abusive behaviour’?

  • The considerations of the welfare of children and the views of the child
  • The effect of a DAPN or a DAPO on orders for Contact and Residence
