Introduction

2021 marks the 5th anniversary of the Third Parties (Rights against Insurers) Act coming into force and the last 12 months has seen a flurry of important cases.

The Act is likely to be invoked more often in future due to the Court of Appeal’s decision in January 2021 that employees can bring claims under the Act directly against insurers in employment tribunals and also due to the increasing number of insolvent policyholders.

The webinar will consider recent developments under the Act and their impact. It is aimed at those involved in litigation against insolvent or bankrupt defendants with insurance cover, as well as being of interest to those representing insurers.

What You Will Learn

This webinar will cover the following:

  • The background to the 2010 Act and how its scope has been expanded
  • Recent key cases Irwell Insurance Co Ltd v Neil Watson Hemmingway Design Ltd (in liquidation), Michael Gemmell v KSL Hair Ltd and AXA Insurance UK PLC and Lord Bishop of Leeds and others v Dixon Cole & Gill & others
  • Future use of the 2010 Act

This webinar was recorded on 17th June 2021
