Introduction

The introduction of the sentencing guidelines for health and safety offences led to a dramatic increase in the level of fines imposed on corporate defendants convicted of offences under the Health and Safety at Work Act 1974.

Whilst it is these cases that have attracted most of the publicity, the guidelines also provide for potential prison sentences for individuals who have committed health and safety offences. With the subsequent introduction of guidelines for manslaughter offences, practitioners and those working in industry need to be aware of the range of health and safety offences that individuals can be liable for and the potential penalties that they face.
