It is not always possible to register the brand a business wants to be known by before it begins to trade. Further, a business may develop secondary brands in the form of product packaging, social media memes or a house style.

In the absence of a trade mark registration, the law of passing off provides some security for the investment a business has to make in its image in order to build market share and reputation.
