Introduction

The rules governing a tenant’s request for consent to alterations are in some ways more accommodating to landlords than the rules which govern consent to assignment or sub-letting. On the face of it, landlords can exercise a high degree of control, with no apparent sanction in the event that the response to a request is held to be unreasonable. Moreover, tenants do not have the weapon of any legal duty to make the decision within a ‘reasonable time’ as a stick with which to beat landlords.

But the reality is that landlords are under increasing pressure from tenants who seek ever more flexible accommodation arrangements, with greater freedom to assign, sub-let and share occupation, and to introduce new uses into a property.

In this virtual classroom seminar, we will consider the changing landscape and best practice in dealing with applications for consent to alterations.
