Introduction

Since January 2021, UK retailers are trading under a new Free Trade Agreement (‘FTA’), called the UK-EU Trade and Cooperation Agreement (‘TCA’) with member states of the EU.

Amongst other things, the TCA provides for so-called ‘preferential tariffs’ (in practice zero tariffs) on goods imported from the UK into the EU and vice versa.

Claiming these preferential tariffs requires a basic understanding of the relevant rules, whether under the TCA or elsewhere.

While we are still working under grace periods in many respects, these will only last until the end of 2021 at best.

This is therefore a good moment to familiarise yourself and your clients with the new rules when exporting goods into the EU, as well as when importing goods from the EU into the UK, and to what extent these rules require you to change your contracts in due course.
