Introduction

Under the new Standards and Regulations, solicitors are required to report serious breaches to the SRA; a requirement that replaces material breach.

This 3 hour live broadcast session provides a discussion of the new concept of serious breach, the policy development behind the new requirement and the difference in the new reporting arrangements.

This essential look at reporting also explains the links between serious breaches and the annual practising certificate renewals process. Annual renewal is both the largest information gathering exercise conducted by the SRA, and a major source of regulatory action; being the driver for practising certificate and firm conditions.

With an in-depth look at common concerns in renewals and anticipated for this year; the changes affecting Registered European Lawyers post-Brexit and the SRA’s latest position on renewal for freelance solicitors will be discussed.

The session is aimed at COLPs, COFAs, Compliance Officers, and those with responsibility for SRA renewals.

You can expect an engaging, interactive session with exercises designed to stimulate learning. Whilst this is a practical session, it is also a safe environment and you will not be expected to discuss compliance at your own firm.

  • The concept of serious breach and the reporting requirements;
  • The 2020 renewals process, what usually happens and changes for this year, including the latest information on renewal requirements for freelance solicitors;
  • Information you and your firm need to provide;
  • The SRA’s risk processes and how they will use the information you report - whether on annual renewal or as a serious breach;
  • Guidance on the latest position regarding practising arrangements for RFLs and RELs post-Brexit;
  • Conditions on firm recognition and practising certificates:
    • Common conditions - how and when they occur;
    • Extra requirements within the renewals process;
    • How to manage conditions within your firm.
  • Anticipated future renewals and reporting developments for 2021 and beyond, including analysis of the impact of both Brexit and the Standards and Regulations so far.
