Introduction

In line with the SRA Handbook, solicitors are to have proper regard to their clients’ mental capacity or other vulnerability and a written complaints procedure which is responsive to the needs of individual clients, especially those who are vulnerable.

Compliance with such matters is a significant issue as more vulnerable adults seek legal advice regarding; financial planning, tax matters, divorce, litigation, conveyancing, wills, trusts and lasting powers of attorney. Being unaware of how to spot abuse, coercion or fraud leaves solicitors exposed to censure by the SRA.
