Introduction

This practical live broadcast, split over two sessions, will consider the key components of both discretionary and mandatory claims for possession of residential property.

In doing so, it will also explore, amongst other things, common defences relied upon by tenants including those under the provisions of the Equality Act 2010.

  • Discretionary Possession Proceedings:
    • The section 8 Notice
    • Issuing proceedings based upon discretionary grounds for possession (focussing on anti-social behaviour)
    • The standard possession procedure
    • Reasonableness and Equality Act defences
    • Applications to suspend
  • Mandatory Possession Proceedings
    • Issuing proceedings against trespassers and other unlawful occupiers
    • The section 21 Notice (focussing on the prescribed requirements and tenancy deposit issues)
    • The accelerated possession procedure
    • Defences including public law and human rights defences
