Planning Law - 2022 Virtual Conference
Chaired by David Forbes, this live online conference will examine a range of important and topical issues.
Each session will provide opportunity for questions and answers.
This live and interactive 5-hour conference will cover the following:
10:00am-11:00am: Planning White Paper, First Homes, & Implications for the Future of Planning
This session will address the key issues including:
- Will the proposals in the White Paper be watered down, and If so by how much?
- How will the proposals help provide 300,000 house per annum?
- Will the First Homes proposals provide the 130,000 affordable homes needed? (according to Shelter)
- How will Local Planning Authorities cope with the proposed reforms without massive additional resources?
11:10am-12:10pm: Planning Obligations & CIL
This session will cover the latest developments in section 106 practice including recent cases.
We will look at the interplay between section 106 agreements and CIL, how successful local authorities have been in spending CIL and how the Government proposes to deal with infrastructure provision in the future.
12:10pm-1:10pm: Biodiversity Net Gain
This session will consider how the Environment Act will put biodiversity gain at the heart of the English planning system. Planning approval will only be granted when the developer has demonstrated that proposals will result in a 10% increase in biodiversity. Furthermore, this increase must be secured for at least 30 years. Offsite work can contribute to the gain and this will play an important role where developers need to maximise the commercial use of the development site itself. Section 106 agreements will have a role to play.
Conservation Covenants are a new tool set out in the Environment Bill and they too will play an important role in securing biodiversity gains. It will also be possible to buy biodiversity credits from the Government in lieu of the obligation to provide biodiversity gain. But these are intended to be prohibitively expensive.
We will review the technical details of the new measures and highlight the actions that will have to be considered and built into development proposals from the earliest stages of planning.

2:00pm-3:00pm: What Is Next for Neighbourhood Planning?
It is now a decade since neighbourhood planning was introduced and it has developed into a very significant element of the modern planning system. So now is an ideal time to take stock of where we have got to with neighbourhood planning and how issues such as the White Paper proposals and the impact of the pandemic could shape its future development.
This session will cover:
- The background to neighbourhood planning including the legal and policy context
- Lessons to learn from recent case law
- Some practice examples in making and adopting neighbourhood plans
- The future of neighbourhood planning
3:15pm-4:15pm: Heritage Assets & Building Britain Beautiful
This session will consider:
- The impact of the proposed Design Guides and importance of design on listed buildings and conservation areas
- Where are we now with protection of the setting of listed buildings and conservation areas?
- Possible effect of proposals to water down Article 4 Directions in conservation areas
- Legal status of the protection of statues and plaques
- Latest case law on listed buildings, conservation areas and trees
