Introduction
Pre and post nuptial/civil partnership agreements are still often seen as only for the rich and famous. But they can be really useful for many clients, helping to avoid uncertainty, stress and cost in the event of future separation. Practitioners can feel apprehensive about them (not unreasonably given the repercussions of getting them wrong).
We need to know what issues to discuss with our clients not just at the outset of the instruction but throughout the process of considering entering into one to drafting to finalising to signing the agreement.
Drafting of the agreement requires great care and attention and there are pitfalls and challenges which must be considered.
