Introduction

This virtual classroom seminar will explore the current topical issues which those drafting notice provisions and seeking to bring breach of warranty claims need to be aware of.

A series of cases will be discussed with the emphasis on practical steps to take to avoid repeating the mistakes that others have made.

This live and interactive session will cover the following:

  • Vendor protection schedules - what notice provisions for breach of warranty claims should be inserted? What are the preferences of the seller and the buyer?
  • Timing requirements - notification by reference to completion date or the date of the buyer’s knowledge?
  • Knowledge of the buyer - how should this be defined to avoid ambiguity?
  • Content of the notice - how detailed does the notice have to be? What is a ‘reasonable level of detail’? Do specific warranties have to be referred to?
  • Format of the notice - in writing and signed?
  • Manner of service - what constitutes valid service of a notice? Will notification by e-mail or being left at a location suffice?
