This live and interactive 5 hour conference will cover the following:

10.00am-11.00am: Varying Estates & Trusts to Secure RNRB & Other IHT Benefits

John Bunker, Irwin Mitchell

Changes in IHT law, and planning practice, mean variations to wills and trusts are often advisable to secure the benefits of mitigating IHT.

Flexibly drawn wills often need rearranging within the two-year period after death, and less flexible wills often call for a deed of variation to meet new opportunities.

This session will cover:

  • Changes to IHT in the 3 March 2021 Budget and any variations that might be worth considering as a result
  • Thorny RNRB issues for wills and trusts and the effective use of trusts, by variation, to address them
  • Variations under sections 142 & 144 IHTA 1984 to make the most of RNRB, in everyday situations
  • A recap on the forms of trust for IHT purposes, now also critical as to whether trusts need to be registered on TRS under the new 5MLD provisions from October 2020
  • The use of the two-year period post death, to consider if a trust is kept going, and needs registering on TRS; and potential variations to rearrange
  • If changes are made to CGT ‘uplift’ on death, as proposed by the OTS, the way it interacts with IHT may require variations too

11.10am-12.10pm: Long-term Tax Planning - The Attractions & Pitfalls

When assessing an IHT planning strategy, generally speaking, if a plan sounds too good to be true, it probably is!

This session will consider what is more likely to work to the benefit of your clients.

It will look at the principles that you should adopt when assessing IHT planning including:

  • Setting the planning in a holistic context
  • Examining the characteristics of planning which works and what normally fails
  • Understanding the difference between retrospective and retroactive legislation
  • Lessons from the courts and the GAAR panel

12.10pm-1.10pm: Tax & the Family Home - Latest Update

Conventional tax planning wisdom holds that using the family home in tax planning should be avoided, yet for some clients there may be no alternative.

This session will look at some options available and explore possible pitfalls.

The session will cover:

  • Gift and leaseback arrangements
  • Sharing arrangements
  • ‘Ingram’ and similar schemes
  • Use of trusts
  • Other options

The last few years have seen significant changes to the position of non-UK domiciles - and not necessarily to their advantage.

The changes introduced in 2017 have substantially eroded the IHT advantages for non-UK domiciles who maintain assets in the UK.

This session will cover:

  • Recent cases on determining domicile
  • The 2017 rules on property
  • The deemed domicile rules
  • Remaining available tax mitigation strategies for non-UK domiciles

3.15pm-4.15pm Pitfalls of IHT - Beware of HMRC!

Many people attempt to circumvent the tax rules to avoid paying large sums on their death.

There are several anti-avoidance measures in place with HMRC, and it is easier than you think to fall foul of these measures if you are not careful!

HMRC are constantly reviewing these measures, and changes are underway.

This session will cover Pre-Owned Asset Tax and Home Loan schemes, including the new ground-breaking case going through the Court on this issue.
