Introduction

Homicide is a highly complex area of criminal law and practice, which presents unique challenges to the practitioner.

This new virtual classroom seminar covers the specific legal complexities and strategic challenges posed by homicide prosecutions in the Crown Court, encompassing murder, manslaughter and fatal road traffic offences.

This interactive broadcast uses case studies to navigate the problems and pitfalls arising. The course is aimed at both prosecutors and defenders; those making charging decisions or representing suspects pre-trial, as well as trial advocates appearing before the Crown Court.

What You Will Learn

This live and interactive broadcast will cover the following:

  • Challenges to causation in homicide cases - intervening and supervening acts; forensic pathology in highly complex cases
  • Secondary liability and group offending - ‘conditional intent’ v foresight post-Jogee; secondary liability for manslaughter in group offending scenarios
  • Gross negligence manslaughter - the exacting threshold for establishing liability for gross negligence manslaughter including in medical manslaughter, deaths in custody and large-scale disasters
  • Diminished responsibility - the interface between advances in psychiatry and criminal law and effective approaches to diminished responsibility in murder cases
  • Loss of control - unpacking the complex statutory framework including the duty of the trial judge to withdraw the defence in cases of evidential insufficiency
