Introduction
This webinar will look at the procedure for claims under Schedule 1 of the Children Act 1989, financial provision for unmarried parents, updating and reviewing the recent caselaw in this area.
It will include a review of these claims which are becoming more frequent for practitioners and which are finally permeating into the more modest asset cases.
What You Will Learn
This webinar will cover the following:
- The procedure used for Schedule 1 claims: including practice points, and the statutes and Procedural Rules relevant to issuing or defending an application
- Consideration of the broad case law, including some modest asset cases, treatment of debt and the parameters of needs
- An investigation of the newer jurisprudence and how that translates into our caseload: this will include not only the inevitable high net worth cases but also modest asset cases and a look at the new child support calculations propounded by Mostyn J
