Introduction

When farmers enter into relationships, including marriages, they often fail to consider the impact on their farming business. This can cause considerable difficulties when those relationships falter or break down.

This virtual classroom seminar is aimed at family lawyers who advise on financial and property matters in Scotland.

What You Will Learn

This live and interactive session will cover the following:

  • Consideration of the distinction between matrimonial property and non-matrimonial property in farming cases
  • A review of the up-to-date caselaw regarding farmland and business as matrimonial or non-matrimonial property
  • An overview of different (farming) business structures involved in such cases
  • A guide to valuation of farmland and other partnership assets
  • The interaction of family law and partnership law on divorce in farming cases
  • A detailed look at matters to consider when drafting pre-nups, post-nups and cohabitation agreements
  • Practical tips for raising actions for divorce

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
