EU & UK Regulation of Cryptoassets - Current Rules & Future Changes
The 5th Money Laundering Directive and local UK regulations recently expanded the anti-money laundering regime to individuals or firms carrying on the business of ‘cryptoasset exchange provider’ and ‘custodian wallet provider’. Other regulations may also apply depending on the nature of the cryptoassets and your role in relation to them.
The UK authorities classify cryptoassets into four categories. If they are considered ‘e-money’ they would trigger the payment services regime; and if ‘securities’ they would trigger investment regulation and restrictions on related marketing or ‘financial promotions’.
There are also new EU and UK plans to regulate the activities of cryptoasset issuers and service providers, as well as the promotion of certain other cryptoassets.
