Introduction

Following the end of transition period, legal advice given by UK-qualified lawyers may no longer attract EU legal professional privilege in the member state jurisdiction by default, as it used to.

EU legal professional privilege applies in competition proceedings conducted by the EU Commission and is to be distinguished from national legal privilege (which potentially applies in e.g. civil law procedures at national level).
