The tide of procurement challenges continues to rise, with all the associated costs this brings for contracting authorities. Careful drafting and detailed knowledge of the regulations and case law can minimise your risks and save costs.

This one day practical course will take a detailed look at what your procurement documents should include, what you need to think about when drafting them and how to minimise the risks of challenges.

What You Will Learn

  • Sources of law and the potential impact of Brexit
  • The tendering contract - Blackpool and Central Tenders Board v White
  • Soft market testing, prior involvement and conflicts of interest
  • The Public Services (Social Value) Act 2012 and the living wage
  • Section 17 LGA 1999, the Best Value order, and Jewish Rights Watch v Leicester
  • Electronic tendering and procurement document availability including CCS guidance
  • Specification drafting and technical standards including 'compatibility' requirements
  • Compulsory contract terms under PCR 2015
  • Enabling variations without breaching Law Society v Legal Services Commission
  • Advertising, Part 4 PCR 2015, restrictions on PQQs and CCS guidance
  • VEAT Notices and Fastweb
  • Drafting OJEU contract notices, including the GPA, 'lots' and the 'appeals' section
  • PQQs, including the CCS template, PAS91, ESPDs, references and 'project-specific questions' in the light of Easycoach and Clinton
  • Notifications to candidates and the importance of 'reasons'
  • ITTs and their alternatives (ISIT, IPD with IFT)
  • Disclosure of historical and TUPE information
  • Award criteria, their disclosure, the ReWIND and evaluation models
  • Clarification and abnormally low tenders Standstill letters (Alcatel), and avoiding 'manifest errors'
  • Contract award notices, Contracts Finder quarterly returns and Reg 84 record keeping
