Introduction

With the profusion of computers in modern organisations, the disclosure of electronic documents has become an increasingly important feature of litigation. However, difficulties with the discovery (and especially with e-discovery) can be time consuming and expensive.

This workshop provides guidance on the rules and process of discovery and the Rules of the Superior Courts (Discovery) 2009, which provide for the discovery of electronically-stored information. To protect their position and discharge their obligations to the Court, lawyers and their clients need to adopt a carefully planned and practical approach to the issue of discovery, designed to balance the need for appropriate disclosure with the need to avoid disproportionate effort and expense.

Potential changes to the law on discovery will also be explored, as it is an area which has been identified as part of a current review of the administration of civil justice in Ireland.
