Every year millions of people in the UK have their holidays or business trips ruined by delayed or cancelled flights yet many do not know they have a right to claim hundreds of pounds of compensation from their airline.

Following Brexit, the EU Regulation has now become a new type of UK legislation known as ‘retained EU law’ and has now been restated into UK law by The Aviation (Consumers) (Amendment) Regulations 2023 (‘ACAR 2023’) that came into force in December 2023.

Presented by Neil Morrison, who successfully represented an air passenger in the well-publicised and reported Scottish Sheriff Court appeal decision of Vergara v Ryanair Ltd, this virtual classroom session will identify the key legal issues that claimant lawyers and air passengers need to know before raising court proceedings against their airlines under both EU Regulation 261/2004 and its UK counterpart, the ACAR 2023. There will be reference to English, Scottish, and European case law to help explain how both the EU and UK legislation has been interpreted by the courts.

This session is aimed at commercial lawyers or claimant lawyers specialising in consumer claims.
