Introduction

Section 1(1) of the Defamation Act introduced the requirement of ‘serious harm’ and since it came into force in 2014 a series of cases have sought to define the precise meaning of this phrase.

These cases culminated in the recent Supreme Court decision in the case of LaChaux v IPL [2019] which set out definitive guidance as to interpretation. This webinar discusses the development of the law in this area.

What You Will Learn

  • Content of s1(1) Defamation Act
  • Presumption of damage
