Introduction

This new virtual classroom seminar will consider pre-grant problems and will provide you with answers and guidance on how to deal with the following situations:

  • What to do when a request for a copy of the will is made by a family member who is not named in the will
  • How to deal with administration in respect of wills that are held by third parties (families or otherwise) who refuse to produce the original document
  • How to deal with situations where you know there has been a will, but you cannot find it
  • Can executors named in the will be forced to act and is it worth doing?

What You Will Learn

This live and interactive session will cover the following:

  • Rules regarding disclosure of wills
  • Making and responding to Larke v Nugus requests
  • The rules and procedure of subpoenas
  • The rules and procedure of admitting missing wills to probate
  • The rules and procedure of citations
  • Costs of the above applications and the PR's/estate’s responsibility for those
