Each session will provide a full opportunity for questions and answers.

This live and interactive 5 hour conference will cover the following:
10am-11am: Planning Update
Chair: Bob McGeady, Ashtons Legal
This session will examine the major planning cases over the last 12 months.
It will cover:
- An assessment of the impact of the decisions on commercial property practice and procedure
- How to structure your cases
- Major proposed changes to planning will be outlined which will affect commercial property with a view to trying to understand what impact those changes will have
Morning Break
11:10am-12:10pm: Development Projects - Latest Update
Peta Dollar, Freelance lecturer, trainer and writer
This session will cover relevant property and construction topics of relevance to those advising on development projects, especially:
- The Building Safety Act 2022 - where are we now?
- Recent cases on rooftop developments
- Recent cases on overage
- Recent cases on conditional contracts and options
12:10pm-1:10pm: Topical Tax Tips and Traps on SDLT
Hannah Mackinlay, Mackinlay Projects Limited
SDLT can be a minefield for commercial property lawyers as it is much more complex than most realise and can result in huge overpayments of tax, or failure to categorise the property appropriately, failure to appreciate the reliefs available and failure to warn the clients of the need for future tax returns. An army of tax-reclaim agents have sprung up to exploit these failures.
With worked examples and red flag lists to take away, this session will look at:
- The most common mistakes in under or over-assessing the consideration
- The reliefs available
- When is a commercial property not a commercial property?
- Associated dangers

2-3pm: Tall Buildings, Mixed-Use Developments & ‘Visual Intrusion’

This session will explore the implications of the Tate Gallery case, including the following:
- How can owners of tall buildings address the risk of liability for overlooking?
- Considerations for mixed-use developments, and repurposing of property
- Moving to the nuisance - might there still be a claim?
- Tenanted buildings - who is liable, landlord or tenant?
- The relevance of the planning process
Afternoon break
3:15-4:15pm: Highways Issues in Development

There are many complex highway issues that may need to be considered when acting for developers.
This session will look at many of these, including:
- Ransom strips
- Visibility splays
- s38 and s278 agreements
- Dedication of highways
- Adopted highways
- Stopping up orders
- Buildings that overhang the highway
- Private roads
- Recent cases and lessons learned
