Commercial property law is an exciting and varied area of practice. It encompasses a fine balance between legal principles and practicality - irrespective of whether acting for seller, purchaser, landlord or tenant. It is essential that all practitioners have a firm grasp and understanding of the main aspects and ancillary areas of law to ensure that the risk of a claim is minimised (if not eradicated altogether).

This course is aimed at beginner level and is ideally suited for commercial property paralegals and newly qualified solicitors and to act as a building block for the next stage of their careers or for those that undertake a mixed area of practice and wish to polish up on the essential elements.

What You Will Learn

This course will cover the following:

  • How VAT applies to commercial property and to establish what is required of the purchaser and seller in those specific circumstances
  • The seller’s obligations as landlord when selling a property subject to and with the benefit of a lease
  • Common law obligations imposed by Scots Law on landlords in leases in the absence of specific provisions on insurance, repairs, damage/destruction and the like
  • Revising full repairing and insuring leases and the balance to be sought in reaching a compromise between landlord and tenant
  • The correct preparation for ancillary lease documents like personal guarantees, rent deposit agreements, licences for works, renunciations, assignations and subleases
