Introduction

Cases involving harm to children are complex and involve multiple agencies. Family court proceedings are usually on-going. Gathering evidence and obtaining third party material and identifying what can and should be used in the Crown Court is not straightforward and requires strategic planning from a very early stage. The process of applying for disclosure of material gathered by and used in the family court proceedings can cause considerable delays and may result in applications to exclude important evidence if not undertaken sufficiently early and with sufficient clarity of purpose.

This webinar will focus on material gathered for and used in family court proceedings and the extent to which it can be deployed in criminal proceedings, with a particular emphasis on statements in family proceedings which are inconsistent with statements in criminal proceedings.

What You Will Learn

This webinar will cover the following:

  • What should be obtained from the family court, how and when?
  • Can expert reports obtained in the family court proceedings be adopted in criminal proceedings and if so, what steps need to be taken?
  • What use, if any, can be made of witness statements made in the family court proceedings? by an accused parent or their spouse, which are inconsistent with an account given in criminal proceedings?
  • Case law
  • This pre-recorded webinar will be streamed at 12:30pm on Wednesday 1st September 2021 and will remain available to view by delegates who have registered by then for 90 days.
