Cases involving harm to children are complex and involve multiple agencies. Family court proceedings are usually on-going. Gathering evidence and obtaining third party material and identifying what can and should be used in the Crown Court is not straightforward and requires strategic planning from a very early stage. The process of applying for disclosure of material gathered by and used in the family court proceedings can cause considerable delays and may result in applications to exclude important evidence if not undertaken sufficiently early and with sufficient clarity of purpose.
This webinar will focus on material gathered for and used in family court proceedings and the extent to which it can be deployed in criminal proceedings, with a particular emphasis on statements in family proceedings which are inconsistent with statements in criminal proceedings.
