Introduction

As the world tries to sadly take the measure of the COVID-19 pandemic, all sectors are assessing the risks and impacts, and commercial property is no different.

Landlords need to consider matters ranging from what duties they may be placed under by Health & Safety legislation to the implications of closure of their premises by government, closure by individual tenants and indeed when they might need to close down a development themselves.

Additional costs such as deep cleaning might arise, and the recoverability of such expenses will be an issue. Tenants will be looking at the ability to withhold rent and potentially whether a lease can be terminated.
